Terms of Service

1. The service

SamitMail gives your business email addresses on your own domain, with webmail, a mobile app, calendar and contacts, spam and phishing protection, and access from mail programs such as Outlook, Apple Mail and Thunderbird. Some features (for example the AI assistant or larger storage) depend on the package you choose.

SamitMail is for everyday business mail between people. It is not a newsletter or bulk-mail service; for that we offer a separate sending service on request.

2. Accounts and workspaces

• The person or company that orders SamitMail for a domain is the workspace owner. The owner must give us accurate contact and billing details and must own or control the domain they connect.
• The workspace owner is responsible for the mailboxes they create, for the people who use them, and for making sure those users follow these terms.
• You must keep your password private, use a strong password, and tell us or your workspace owner at once if you think someone else has used your mailbox. We recommend turning on two-step verification.
• You must be at least 18 years old, or the age of majority where you live, to be a workspace owner. Mailbox users must be at least 13.

3. Acceptable use

You must not use SamitMail to:

• send spam: unsolicited bulk or commercial mail, mail to purchased, rented or scraped address lists, or mail to people who have not agreed to receive it;
• send phishing, scams or fraud, or pretend to be another person or organisation;
• send malware, viruses or harmful links, or try to break into other systems;
• send or store content that is illegal in Bangladesh, sexually exploits children, harasses or threatens people, or infringes others' rights (including copyright);
• hide or forge where a message comes from, or get around our sending limits, security checks or filters;
• resell SamitMail or give access to others outside your organisation without a written agreement with us;
• overload, probe or disrupt our servers or other customers.

Our systems check mail automatically for spam, phishing and abuse. We may hold, block or reject messages that look harmful, and we may limit or suspend a mailbox that is sending them (see section 10). If your mailbox is compromised and used to send spam, we will lock it until the password is changed.

4. Sending limits and storage

• Each package has a storage size per mailbox and a daily sending limit (for example Basic: 1 GB and 200 messages a day). The current limits are shown on our pricing and in your account.
• Messages over the daily or hourly limit are not sent until the limit resets. A message sent to many recipients counts once per recipient.
• When a mailbox is full, new mail to it may be refused until space is freed or the package is upgraded.
• We may change limits to protect the service, and will tell workspace owners in advance of any permanent reduction.

5. Mobile app

The SamitMail app is free to download for SamitMail users. We grant you a personal, non-transferable licence to use it with your SamitMail mailbox. Do not copy, modify, reverse-engineer or redistribute the app, except where the law allows. App stores (Google Play, Apple App Store) have their own terms, which also apply to how you get the app; they are not responsible for the app or its support — we are.

6. AI assistant

• The AI assistant is optional and is available in packages that include it. Your workspace owner and you can each turn it off.
• It creates text automatically and can make mistakes. You are responsible for checking what it writes before you send or rely on it.
• Use of the assistant is subject to fair-use daily limits.
• When you use it, the text you ask it to work on is sent to our AI provider, as explained in the privacy policy.

7. Prices, billing and refunds

• Prices are per mailbox per month in Bangladeshi Taka (BDT), as shown on our website or in your order. Taxes and payment charges are added where they apply.
• Service is paid in advance for the billing period you choose. Mailboxes added during a period are charged from the day they are added.
• If payment is overdue, we will remind you; after 7 days we may suspend sending, and after 30 days we may suspend the workspace. Your mail is kept during suspension as described in section 10.
• We may change prices for future billing periods with at least 30 days' notice to the workspace owner.
• Refunds follow SAM IT PARK's refund policy.

8. Your data

• Your mail, contacts, calendar and files belong to you (or to your workspace owner). We do not claim ownership of them.
• You give us permission to store, process, scan for security and transmit your data only as needed to provide and protect the service.
• How we collect, use and protect information is described in our privacy policy.
• You can export your mail at any time with any IMAP mail program. We can also help migrate your mail into or out of SamitMail.
• You are responsible for keeping your own copies of mail that is important to you. We back up the service, but backups are for recovering the system, not a guarantee that a message you deleted can be restored.

9. Availability and support

We work to keep SamitMail available all the time, and incoming mail is held and retried by the sending server if we are briefly unreachable. We may need short maintenance windows, which we try to schedule outside business hours and announce in advance when they are planned. We do not promise the service will never be interrupted.

10. Suspension and termination

• You can cancel at any time by telling us or by removing mailboxes. Cancellation takes effect at the end of the paid period.
• We may suspend a mailbox or workspace immediately if it breaks section 3, is compromised, puts the service or other customers at risk, or if the law requires it. Where possible we will tell the workspace owner and give a chance to fix the problem first.
• We may end the service for a workspace for serious or repeated breaches of these terms, or for non-payment after 30 days.
• After cancellation or termination, you have 30 days to export your mail. After that, the mailboxes and their data are permanently deleted.

11. Warranty and liability

We provide SamitMail with reasonable skill and care. Apart from that, the service is provided "as is", and we do not promise that every message will be delivered, that spam filtering is perfect, or that the service is free of errors.

To the extent the law allows, SAM IT PARK is not liable for indirect or consequential losses, such as lost profits, business or data, and our total liability for any claim relating to SamitMail is limited to the amount the workspace owner paid us for the service in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You are responsible for the content you send and agree to cover our reasonable losses if a claim is made against us because of mail you sent in breach of these terms.

12. Law, changes and contact

• These terms are governed by the laws of Bangladesh, and the courts of Dhaka, Bangladesh have jurisdiction over any dispute. We will always try to settle a problem with you directly first.
• We may update these terms. We will change the date at the top, and for important changes we will tell workspace owners at least 30 days before they take effect. Continuing to use SamitMail after that means you accept the new terms.
• If any part of these terms cannot be enforced, the rest still applies.
• These terms work together with SAM IT PARK's general terms of service. Where they differ for SamitMail, this page applies. A separate written agreement with a customer takes priority over both.
